A. Extent of Limited Warranty
1. Gartner Studios (Gartner) warrants to the end-user customer that the
Gartner products will be free from defects in material and workmanship.
2. Gartner Studios, Inc. makes no warranties, express, implied or statutory, as
to any other matters, including but not limited to non-infringement of third party rights,
merchantability, or fitness for any particular purpose.
3. For software products, Gartner Studios, Inc. and its suppliers do not and
cannot warrant the performance or results you may obtain by using the software.
Gartner does not warrant that the operation of any product will be uninterrupted or
error free.
4. For printable products, Gartner does not warrant that the operation of every
Gartner printable products will be uninterrupted or error free with every available
printer. Consumers are strongly encouraged to review their owner’s manuals for
product and printing compatibility prior to operation. Specifically, consumers should
review all information related to media type and size specifications prior to using any
products.
5. Gartner's limited warranty covers only those defects which arise as a result of
normal use of the product, and does not apply to any:
A. Use or application of software, electronic media, cameras, printers,
parts, or supplies not provided or supported by Gartner; or
B. Operation outside the product's specifications.
6. If Gartner receives, during the applicable warranty period, notice of a defect
in any Gartner product which is covered by Gartner's warranty, Gartner shall replace
the defective Gartner product.
7. If Gartner is unable to replace, as applicable, a defective product which is
covered by Gartner's warranty, Gartner shall, within a reasonable time after being
notified of the defect, refund the purchase price for the product.
8. Gartner shall have no obligation to replace, or refund until the customer
returns the defective product to Gartner or provide the original receipt or invoice of the
defective product.
9. Any replacement product may be either new or like-new, provided that it has
functionality at least equal to that of the product being replaced.
10. Gartner's limited warranty is valid in any country where the covered Gartner
product is distributed by Gartner.
B. Disclaimer of Warranties:
A. Limitation of Damages: In no event will Gartner Studios, Inc. or its suppliers
be liable for any consequential, indirect, incidental, punitive or special damages,
including any lost profits or lost savings, even if a representative of Gartner Studios,
Inc. or any supplier has been advised of the possibility of such damages, or for any
claim by any third party.
B. Copying Software: You may not copy or reproduce any part of the software
or related material, except as permitted by the Copyright Act of the United States, Title
17, United States Code. You may not copy, lend, lease, rent, decompile, reverse-
engineer, disassemble or alter the Software in any way or remove or alter copyright
notices.
C. Terms of Use
1. Use of Images: You may display, reproduce and distribute any of the stock
file images provided on the website. You may not market any of these works as clip art,
photography, or other content. Stock files may not be used in the production of
libelous, defamatory, fraudulent, infringing, lewd, obscene or pornographic material or
in any otherwise illegal manner. You may not register or claim any trademark rights in
the stock files or derivative works thereof.
